Please read these Terms of Service carefully before accessing or using the ChatExpert platform (chatexpert.in).
Acceptance of Terms
By creating an account, connecting a WhatsApp Business Account, or accessing the services provided by ChatExpert Solutions ("ChatExpert", "we", "us", or "our") at chatexpert.in, you ("Customer", "Subscriber", or "User") agree to be bound by these Terms of Service, our Privacy Policy, and our Cancellation & Refund Policy.
If you are agreeing to these Terms on behalf of a company, clinic, hospital, or other legal entity, you represent that you have the full legal authority to bind such entity to these Terms.
Service Scope & AI Capabilities
ChatExpert provides a multi-tenant cloud SaaS platform that connects business WhatsApp numbers to custom-trained AI models for automated customer service, lead qualification, appointment booking, follow-ups, and live agent handoffs.
AI Assistant Disclaimer & Human Supervision
ChatExpert utilizes advanced Large Language Models (LLMs) to generate conversational responses. While ChatExpert implements rigorous prompt constraints, hallucination safeguards, and intent classification, AI responses are generated algorithmically. The Customer agrees to monitor their bot's automated conversations and maintains final responsibility for customer communications, clinical advice boundaries, and human escalations.
WhatsApp & Meta Policy Compliance
Your use of ChatExpert is strictly conditioned upon compliance with Meta’s official WhatsApp Business Messaging Policy and WhatsApp Commerce Policy.
- Zero Spam Tolerance: You must not send unsolicited broadcast messages, misleading promotions, or spam to WhatsApp users.
- Opt-In Requirement: You must obtain clear opt-in consent from your customers prior to initiating proactive outbound WhatsApp messages outside the 24-hour customer service window.
- Prohibited Categories: ChatExpert cannot be used for illegal goods, weapons, adult content, fraudulent schemes, or unlicensed medical/pharmaceutical sales prohibited by Meta.
- Account Suspension: Violation of Meta policies may result in immediate suspension of your WhatsApp Business Account by Meta, for which ChatExpert holds no liability.
Subscriptions, Billing & Taxes
Free Trial: New accounts may receive a free trial period. No credit card is required to initiate the trial.
Billing Cycle: Paid subscriptions (Starter, Professional, Enterprise) are billed in advance on a monthly or annual recurring basis via our payment gateway partners (Razorpay / Stripe).
Taxes: All applicable taxes (including Goods and Services Tax / GST in India) are added to subscription invoices in accordance with applicable tax regulations.
Meta WhatsApp Conversation Charges: Standard WhatsApp Cloud API messaging conversation fees charged by Meta (if applicable) are billed based on your Meta Business Account configuration.
Intellectual Property & Data Ownership
Your Data: You retain 100% full ownership, rights, and title to all customer data, conversation logs, product catalogs, and business assets uploaded to ChatExpert.
Our Platform: ChatExpert retains all intellectual property rights in and to the SaaS platform, software code, algorithms, UI components, APIs, and brand assets. You may not reverse engineer, decompile, or copy the platform.
Limitation of Liability
To the maximum extent permitted by applicable law, ChatExpert and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of business goodwill, or service interruptions resulting from Meta API outages, telecom disruptions, or AI conversation errors. Our aggregate liability under this agreement shall not exceed the subscription fees paid by you in the three (3) months preceding the claim.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Hyderabad, Telangana, India.
